SHIPPING: TERMS & CONDITIONS

(This form is intended for individual consumers looking to purchase retail product. Please do not submit this form if you are a retailer, restaurant, ice cream parlor, distributor, etc. Use our regular contact form.)

Shipment Processing:

Tofutti Brands, Inc. processes orders within 2-3 business days. Orders are not shipped or delivered on weekends or holidays. Generally, orders are shipped on Monday or Tuesday, as to avoid shipments being put on hold by the carrier over the weekend. Orders placed on Wednesday, Thursday, or Friday will usually be shipped the following Monday or Tuesday, unless a holiday precludes shipping on those days.

If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email or telephone. Tofutti Brands, Inc. is not responsible for delays due to the carrier, natural disaster, or issues related to the stated delivery address.

Payment & Shipping Rates:

After an order has been placed, a representative from Tofutti will contact you regarding the total cost of your order within 2-3 business days (usually sooner). Due to the high cost of shipping, the resulting price per item will exceed prices set by brick & mortar stores when the final total cost of your order is tabulated; we cannot offer a manufacture’s discount. We recommend placing larger orders (by the case or equivalent number), as shipping rates make small orders extremely expensive per item. Tofutti Brands, Inc. is located in Union County New Jersey, therefore the cost of shipping increases incrementally the further west the delivery address is from Tofutti headquarters. Shipping to the West Coast is very expensive.

Before placing an online order, we encourage you to use our Product Finder and/or talk to your local retailer about a special order. PlantX is another option we recommend; however, please note that PlantX is an independent retailer, separate from Tofutti Brands, Inc., should any issues with orders arise, please contact Plantx directly. We cannot assist you with your PlantX order(s).

When contacted, the Tofutti representative will provide you with payment instructions. All orders must be paid in advance. Our preferred method of payment is through PayPal.

Tofutti is not responsible for problems caused by an invalid or incorrect shipping address given to us. Please be sure that the supplied delivery address is correct and can receive packages in a timely manner; delays in you taking possession of the delivery may affect the product contained within. Tofutti is not responsible if the package cannot be delivered, is turned away, is left unattended after delivery, is damaged during transit (shipping), is damaged after it has been delivered, or is suspected of having been lost or stolen after being delivered or during transit (shipping). It is important to check your tracking number and anticipate your delivery.

Once you have received your delivery, immediately store product in either the refrigerator or freezer.

Product Availability:

If we are out of stock for a particular product, the Tofutti representative will notify you via email or telephone correspondence.

Shipment Confirmation & Order Tracking:

Tofutti Brands, Inc. will supply a confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active once the carrier takes possession of the shipment. All orders are shipped via UPS and require a valid mailing address; orders cannot be shipped to P.O. Boxes.

• Refrigerated orders include frozen gel packs to keep product cold.

• Frozen orders are packed with dry ice in order to keep product frozen. Be careful when handling dry ice; Tofutti Brands, Inc. is not responsible for any injuries caused by dry ice used in shipping.

• Refrigerated and frozen products cannot be combined and must ship separately.

• We recommend ordering no less than six total units per refrigerated order or per frozen order.

Customs, Duties & Taxes:

We are not responsible for any taxes and/or additional fees applied to your order. All fees imposed during or after shipping are the responsibility of the customer.

International Shipping:

We do not ship to customers outside of the U.S.

Indemnification:

If you violate any terms of this agreement, make any material misstatements within this application or in relationship to any information you provide in this application, you agree to indemnify and hold Tofutti Brands, Inc. and its entities harmless from and against any and all claims, actions, or demands including without limitation reasonable legal and accounting fees.

This agreement is governed by the laws of the State of New Jersey applicable to contracts executed and performed entirely within that state, except conflict of law's provisions. This agreement was entered into in Cranford, New Jersey and any necessary arbitration or litigation will take place in Union County, New Jersey.
